Terms of Service

Overview

These Terms of Service ("Terms") govern your access to and use of the Facebetter software-as-a-service platform, developer SDKs, documentation, demo applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Service.

Definitions

  • "We", "Us", and "Facebetter" refer to the provider of the Service.
  • "You" and "Customer" refer to the individual or entity using the Service.
  • "Account" means the user profile and configuration created to access the Service.
  • "SDK" means software development kits, libraries, and code samples we provide.

Eligibility and Account

  • You must be at least the age of majority in your jurisdiction to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • You must provide accurate and complete registration information and keep it up to date.

License and Acceptable Use

  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and SDKs in accordance with the documentation and these Terms.
  • You shall not: (i) reverse engineer, decompile, or disassemble the Service or SDKs; (ii) circumvent technical restrictions; (iii) use the Service to build a competing product; (iv) use the Service for unlawful, harmful, or infringing purposes; (v) resell, sublicense, or share access except as expressly permitted.
  • You must comply with all applicable laws and regulations when using the Service.

Fair Use

  • Our public self-serve plans are intended for reasonable use.
  • If you need very large scale (high concurrency/high request volume/multiple projects or apps), or enterprise needs such as SLA, private deployment, offline licensing, customization, or dedicated support, please contact us to discuss the best option.
  • To protect service stability and a fair experience for all users, we may apply rate limits, suspend service, or require an upgraded plan in cases of abnormal high load or abuse.
  • Where practical, we will make reasonable efforts to provide notice or guidance (except where prohibited for legal or security reasons).

Billing and Payment

Free Plan

  • Default Plan: All newly registered accounts automatically receive the free plan at no cost.
  • Monthly Quota: The free plan provides 5,000 minutes per month. After exceeding the quota, your project will be unavailable until the next calendar month.
  • Feature Scope: Supports basic beauty, face reshaping, makeup, and virtual background features - identical to Pro+ plan functionality.
  • Platform Support: No platform limitations. Available on all supported platforms (iOS, Android, macOS, Windows, Linux, Web, HarmonyOS, etc.).
  • Watermark: To prevent abuse, a "facebetter.net" watermark appears in the top-right corner of videos/images.
  • Upgrade Option: You can upgrade to a paid plan anytime to remove the watermark, increase your quota, and unlock advanced features. See Plans & Billing.

Subscription Services

  • We offer multiple subscription plans (e.g., Basic, Pro, Pro+, Ultra). For pricing and features, please see Plans & Pricing.
  • Subscription fees are clearly displayed in your dashboard or checkout page.
  • All prices are in US Dollars (USD) and processed through the Stripe payment platform.

Payment Methods

  • We use Stripe as our third-party payment processor, supporting credit cards, debit cards, and other payment methods.
  • You authorize us and Stripe to charge your selected payment method for all applicable fees.
  • Stripe complies with PCI-DSS security standards. We do not store complete bank card information.

Auto-Renewal

Monthly/Annual Subscription:

  • All paid subscriptions automatically renew at the end of each billing cycle unless you cancel.
  • The system will automatically charge your linked payment method before the billing cycle ends.
  • We will send you an email reminder 3 days before renewal.
  • If auto-renewal fails (e.g., expired payment method or insufficient funds), we will notify you to update payment information.

Usage-Based Billing:

  • Usage-based billing is billed monthly based on actual minutes consumed.
  • Transparent billing with no monthly commitment.
  • Billing cycle is the calendar month.

Subscription Cancellation

  • You can cancel your subscription at any time in the Dashboard.
  • After cancellation, you can still use the service until the end of the current billing cycle.
  • After cancellation, auto-renewal will stop and no refund will be issued for the remaining time.
  • If you wish to resubscribe, you can purchase again in the dashboard.

Special Case Refunds

While normal subscriptions no longer support refunds, you can contact support for refunds in the following special cases:

  • System failures causing prolonged service unavailability (over 24 hours)
  • System errors resulting in duplicate charges
  • Other special cases confirmed after review

Price Changes

  • We reserve the right to change prices at any time.
  • Price changes will be notified 30 days in advance via email or website announcement.
  • Existing subscriptions are not affected by price changes during the current billing cycle.
  • Renewals will be charged at the new price. You may choose to cancel before the price change takes effect.

Taxes

  • Depending on your location, you may be subject to Value Added Tax (VAT), Goods and Services Tax (GST), or other taxes.
  • Applicable taxes will be displayed at checkout and included in the total amount.
  • You are responsible for ensuring accurate tax information.

Payment Failures

  • If payment fails, we will notify you via email and request updated payment information.
  • Continued payment failures may result in your subscription being suspended or cancelled.
  • During subscription suspension, API access will be restricted.

Invoices

  • You can download invoices in the "Billing" section of your dashboard.
  • Invoices are automatically generated after payment completion.
  • For VAT invoices or special format invoices, please contact facebetter@pixpark.net.

Dispute Resolution

  • If you have questions about billing, please contact us within 30 days of receiving the bill.
  • For unpaid or disputed charges, we may suspend or terminate service access.
  • We will make every effort to resolve billing disputes through friendly negotiation.

Service Availability and Support

  • We aim to provide reliable Service but do not guarantee uninterrupted availability.
  • Maintenance, updates, or third-party outages may affect availability.
  • Support channels and SLAs, if any, are described in the documentation or your order form.

Intellectual Property

  • We retain all rights, title, and interest in and to the Service, SDKs, documentation, and all associated intellectual property.
  • You retain ownership of your applications and content you create using the Service, subject to our rights in the underlying technology.

Data and Privacy

  • Our use of personal data is governed by our Privacy Policy.
  • You are responsible for obtaining appropriate consents and providing notices to end users where required.
  • You must not submit sensitive personal data (e.g., health, biometric, or financial information) unless explicitly permitted and compliant with applicable law.

Third-Party Services

  • The Service may integrate with third-party providers (e.g., authentication via Supabase, GitHub, Google). Your use of those services is subject to their terms.
  • We are not responsible for third-party services and do not control their availability or policies.

Compliance and Security

  • You must implement reasonable security measures in your applications that use our SDKs.
  • Do not expose credentials, license keys, or private endpoints publicly.
  • Report suspected vulnerabilities to us through the designated channel.

Beta and Experimental Features

  • We may offer beta, preview, or experimental features. Such features are provided "as is" without warranties and may be changed or discontinued at any time.

Warranties and Disclaimers

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEBETTER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Termination

  • You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms or for non-payment.
  • Upon termination, your right to use the Service ceases, but certain provisions (e.g., intellectual property, limitations of liability) will survive.

Changes to Terms

  • We may update these Terms from time to time. Material changes will be communicated via the website or dashboard.
  • Continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the jurisdiction where Facebetter is established, without regard to conflict of law principles.
  • Any disputes shall be resolved through good-faith negotiations. If unresolved, disputes may be submitted to arbitration or the competent courts of that jurisdiction, as applicable.
